Under the Ontario Dog Owners’ Liability Act, a dog owner is liable for damages resulting from a bite or an attack on another person or a domestic animal.

The Act is stated to be one of strict liability in the sense that the dog owner will be held responsible regardless of the owner’s knowledge of the dog’s propensity to bite or attack, or the negligence of the dog owner.
The Act also provides an expansive definition of the term “owner”, which includes any person who possesses or harbours a dog and where the owner is under the age of 18, the owner of a dog will be presumed to be the person who is responsible for the custody of the minor.
